Bhainsla to meet panel tomorrow
Gurjar leader to appear before Justice IS Israni committee to argue for 5% reservation Gurjar leader Kirori Singh Bhainsla could finally be appearing before the Justice IS Israni committee to argue for 5% reservation for his and three other communities in the state. Disclosing his plans, Bhainsla told reporters on Tuesday that he shall be meeting the committee on April 29. The Gurjar leader was scheduled to meet the committee on Saturday last, but later changed his plans citing health reasons. The Gurjars, meanwhile, want that the state government should plead before the high court for allowing their quota while shelving the case of economically backward classes (EBCs) for the time being. "The government can take up the demand of EBCs at a later stage once the necessary amendment in the Constitution is introduced by Parliament," reasoned Roop Singh, a Bhainsla aide. The reservation Act of 2009 that provides 5% quota to Gurjars, Rebaris, Garia-Lohars and Banjaras and 14% to EBCs, over and above the already existing 49% total reservation in the state, was stalled by the high court last year. The court observed that besides exceeding the 50% cap on the overall quota, the Act provided reservation benefit to EBCs even though the Constitution did not allow that. "The Act's preamble clearly mentions that Gurjars, Rebaris, Garia-Lohars and Banjaras qualify for a special quota as these communities are the most backward among the backward communities of the state. The state government can, therefore, argue for total 54% reservation in Rajasthan under special circumstances, as had been allowed in Maharashtra by the Supreme Court," Singh told DNA. Meanwhile, the Gurjars' mass mahapadaavs at Mehrawar near Bayana and Sikandara near Dausa in support of their reservation demand continued on Tuesday. Furthermore, the Gurjar sit-ins at most of the other places across Rajasthan is continuing since April 14.

Say it’s neither govt nor a high court committee and is unlikely to solve the deadlock over reservation
Even as the Justice IS Israni committee recorded statements of government officials on the Gurjar quota demand on Thursday, the agitating leaders have expressed doubt over the committee’s usefulness in resolving the contentious reservation issue. Chief minister Ashok Gehlot, on the other hand, has expressed his government’s helplessness in resolving the issue outside the court. Speaking to reporters, Gehlot pointed out that the same Gurjar leaders (Kirori Singh Bhainsla and his supporters) had expressed faith in the reservation Act that today lies stalled before the high court. “We are trying our best to get matter decided in court at the earliest.” Gurjars under Bhainsla, meanwhile, continued their sit-in at Sikandara demanding a time frame from the state government within which 5% quota for the community would be granted. “We understand there are legal hurdles, but the government can still tell a time limit,” Roop Singh, a close aide of Bhainsla, told DNA. He added that if the government were honest in its intentions it could meet Gurjars’ quota demand within couple of months. Elaborating his statement, Singh said, “The government can scrap the present reservation Act, which everyone says is illegal. Within the next 3-4 months, the government can come up with another Act that provides 5% quota for Gurjars under special conditions.” The Gurjar leader implied that the new Act could exclude the 14% quota for economically backward classes (EBCs) until an amendment was introduced in the Constitution. “The state government can spell out the conditions that allow special quota for Gurjars and fulfil the Supreme Court’s requirement for exceeding the 50% cap on total reservation,” Singh reasoned. He also questioned utility of Justice Israni committee. “It’s neither a government committee nor a high court committee. We will surely present our case before it whenever we are invited, but the committee is unlikely to be of any use in solving our problem,” Singh told DNA.

Dear Manviner I'm Not agree with on get st quota in Rajasthan. That side have problem is different and I travel Rajasthan many time. Where is the problem ? Problem start with Meena's because they are do harworking in educations side like Bihari People. They get all Good Govt. Jobs. and people educations are very low and this time Meenas are ruled to all cast like Rajput and Jats. Rajput and Jats are not want comes in seen in any situations they forced to our people you do everything and our people are angry very eary. If we get ST quota we are not solved this problems. First we give educations to our people and forced to all for edcuations. I live in Delhi in Chandrawel village near the Delhi Univercity and you know my agegroup boys only 2 or 3 boys take a degree from DU. Other than what they do depend on Rent and our old business Dairy. Punjab and Haryanas people are why rich to us because they are educated. And they take all the Good things like money, infrastucture, Business to Central govt. for their peoples. And we are fight only for littel things. Like ST quota etc. You seen UP everybody says its Ulta Pardesh. Why ? we are go everytime wrong side and satisfy on littel things. And feel very happy.

Hi Virender, How are you dear ! My friend my opinion is different, I think that ST Quata (5% Special Quata now) will work for our people in Rajasthan and further I think It had started working befare getting the clear quta as people are being aware and now they started to be serius towards the career and towards the community uprising. Its True I have seen the changes in people (Gurjars) thinking... Defintly ST Quata works you can see Meena's ( In Rajasthan and others states too) and Harijans I will give you an practical example .. I used to read Emloyment News paper these days since last a couple of years, I saw that the finilised candidate in most of the results are mostly meenas and Gujars are rarely ( I personly scan the news paper for the Gujars if I see a Gurjar candidate name in the result list it pleases me) Now come to the point - the reson of the above fact is that they get reserve sheets due to quata another example if I applied in IAS my age must not be more than 30 Years , I can take the benifite of OBC( only non creamy layer) but Gurjars of NCR rarely comes in OBC non cremy layer so I can't take the benefit of that but STs has no age bar. Moreover, If I will give the exam I will get only 4 attempts, but SCs and STs have no limit of attemts ? U can chek our UPSC website : www.upsc.gov.inFurther, If I apply in a Nationilsed bank or Government post I have to Pay the full fee for the examination which is these days is from Rs 350 to Rs. 700, with application fees, but SC and ST have to Pay only Rs 50/- but mostly they dont have to pay any fee. u can chek the above site for the same. ST/ SC get the reservation in Political sheets , sheets is reserved ST and SC in Politics thatswhy they surely enter in politics and give benefits to their people. Yes! I agree with you that our people need a good education without that we wont be able to stand in future but I feel that our people have started changing their attitude towards education. Bhainsla meets quota panel, chief minister
Threatens to intensify agitation if government fails to grant them 5% reservation by May 3 The Gurjars have demanded 5% separate quota for themselves and three other communities from the 21% quota being given to the other backward classes (OBCs) in the state. Gurjar leader Kirori Singh Bhainsla placed the demand before the Justice IS Israni committee on Thursday. Earlier in the day, Bhainsla also met chief minister Ashok Gehlot over the quota issue. The Gurjars are currently included in the OBC category for granting reservation benefits in government jobs and educational institutions. The Jats, who are also part of the OBCs, are opposed to proposed division of the 21% quota and had recently registered their disagreement in this regard with the Justice Israni committee. Bhainsla, along with his close aides like Harprasad and Roop Singh, held discussions with the Justice Israni committee in the city for nearly 40-minutes on Thursday afternoon. Talking to reporters after the meeting, Bhainsla said, "Our main demand is for a separate 5% quota within the total reservation limit (set by the Constitution) of 50%." At the same time, Bhainsla issued a fresh time limit for the state government to fulfil the community's demand. "We will intensify our agitation if the government fails to grant us 5% quota by May 3," he said. Since April 14 hundreds of Gurjars are observing sit-in at Sikandara and different places of eastern Rajasthan to press for their quota demand. Justice Israni confirmed that Bhainsla and his supporters had asked for 5% separate quota within the 21% OBC quota. "The committee will look for a solution that is acceptable to the Gurjars and the government also faces no legal problem in accepting it," he told reporters. He added that the committee would seek legal opinions about suggesting 5% quota for Gurjars, Rebaris, Garia-Lohars and Banjaras within the 21% quota for OBCs or finding some other way out. The committee is expected to submit its report over the issue by May 3 when the high court is scheduled to hear the dispute.

Israni panel’s report to the state on Gurjar reservation demand likely to be made public
The Rajasthan high court would hear the reservation dispute on Monday after which the ongoing Gurjar protests for quota in government jobs are expected to change course of action. The Justice IS Israni committee’s report to the state government about suggestions on the controversial quota demand is also expected to be made public on Monday. The same day the Gurjars have called a mahapanchayat at Mehrawar near Bayana where agitation leader Kirori Singh Bhainsla would be announcing the protest’s future course of action. Hardly a kilometre from Mehrawar is Pilukapura where the Gurjars’ violent agitation of 2008 started. “If the Justice Israni committee report recommends prompt grant of 5% quota to Gurjars and three other communities, the agitation might end. Otherwise, the agitation that is going on for more than a month now shall be intensified,” warned Roop Singh, a close Bhainsla aide and spokesperson for the Gurjar Arakshan Sangharsh Samiti. Bhainsla had set May 3 as the deadline for the state government to allow 5% quota for Gurjars. Even as the community leader has sought 5% quota within the 50% overall limit of reservation in the state, last week he made a representation before the Justice Israni committee seeking 5% quota within the 21% reservation allowed to other backward classes (OBCs). This sparked off strong protests from members of various communities falling under the OBC category. Among others, the Jat and the Yadav communities, registered strong opposition to any division within the OBC quota. Meanwhile, the Meena community leader Kirori Lal Meena supported the Gurjars’ demand for quota. On Sunday, the Meena leader reached Sikandara where the Gurjars have been staging a mass sit-in for the past 16 days. Addressing the protesters gathered along the Jaipur-Agra national highway at Sikandara, Meena said he would fight with “his blood” for the Gurjars’ right.

Remaining 4% reservation to Gurjars will be given after high court decision
After three years of bloodshed, relentless talks and frequent agitations, Gurjar leader Kirori Singh Bhainsla finally has something concrete in his pocket ¡ª 1% confirmed quota for his community in government jobs. The Gurjar leader called off his one-and-a-half-month-old agitation on Wednesday, after he accepted chief minister Ashok Gehlot¡¯s formula of giving to Gurjars 5% reservation in two installments. While a per cent of it would be given immediately, the remaining 4% would be given after the high court decides the fate of an earlier law promising 5% reservation to Gurjars and a few other communities. The government would reserve 4% seats for Gurjars till the HC decision. The decision came following a marathon meeting of four hours between Bhainsla and Gehlot at latter¡¯s official residence. It is learnt that the CM categorically told Bhainsla that the government would not ban recruitments. Instead, he reiterated the old formula of keeping a backlog in recruitments in addition to 1% reservation which is available within the 50% limit. ¡°There is scope of 1% reservation to be given, as existing reservation in the state is 49% while the limit is 50%. This 1% reservation would be given to Gurjars immediately,¡± home minister and member of three cabinet ministers¡¯ committee formed to talk with Gurjars said. ¡°For the remaining 4%, the government would keep a backlog in the future recruitments till the high court decides this matter,¡± he added. While, this backlog would be effective from backdate of one year with a rider that the high court approves the new reservation Act, however, till then Gurjars would continue to enjoy reservation under the OBC category. The government has also proposed relaxation in age limit for Gurjar candidates. It has also promised to work for a quick judgement by the high court. In the eventuality of high court rejecting the new reservation Act, the government has reportedly offered to bring in a new proposal in the cabinet and get it approved.This,however, is not officially confirmed. Later, Bhainsla told mediapersons that talks were held in cordial environment and he was satisfied with the government¡¯s response. ¡°The government has already given 5% reservation, the only thing remained is its implementation to which the government has reiterated its commitment and promised to strongly present the case in the high court,¡± he said.Earlier, Bhainsla paid an unexpected visit to Jaipur in the morning for the meeting with the CM. Bhainsla was adamant on holding talks in Madanpura, the place of the agitation and declined to come to Jaipur. Bhainsla quits BJP
Gurjar leader Kirori Singh Bhainsla on Monday declared that he was resigning from the BJP membership. Bhainsla, who joined the party in April 2009, recently became a part of BJP national executive committee formed by president Nitin Gadkari. Taking exception to the allegations that he was trying to indulge in politics in the name of reservation, Bhainsla said that he would take up the cause of his community by dissociating himself from the party. “Chief minister Ashok Gehlot and Congress have been accusing me of playing politics on the issue of reservation. I am being accused of raising the issue for some political gains; nothing is more important to me than the cause of my community,’’ Bhainsla told DNA. “I will do my best for the interest of my community and will not allow them [government] to take Gurjars for a ride,” said Bhainsla, indicating that he was all set to mobilise his community for a bigger agitation. Bhainsla, who led the Gurjar agitations during Vasundhara Raje-led BJP regime was said to have developed close proximity with some saffron party leaders in the wake of reservation bill passed by the previous government.

Legal hurdles may trip quota deal
Experts believe that no community could derive benefits from two separate categories
Legal opinions seem to be divided on the validity of the Gurjar community being extended notional vacancies for the community and the fact that 1% reservation is being granted under Special Backward Category and remaining 4% under existing OBC reservation quota. The government has carefully avoided a clear-cut solution if the present special 5% reservation package fails to get the clearance of the high court. “The government in its statement has carefully omitted its strategy if the high court squashes the special reservation package proposed to the Gurjars,” said a Gurjar leader. The decision to extend 1% reservation from the permitted 50% quota to community members who has failed to benefit from the existing OBC reservation is likely to be challenged since no community could derive benefits from two separate categories. However, the Punjab government has reportedly introduced some similar special category within the quota framework. “It could be easily challenged through PIL or legal petition before the court. It will be difficult for it to stand legal scrutiny,” said AK Jain, Rajasthan high court lawyer. The state government has claimed that till the HC takes a final call in the matter, the government would keep aside 4% and 14% of the vacancies for Economically Backward Community (EBC) and Special Backward Community (SBC). Prominent members of the Gurjar community involved in ensuring an effective and legal solution to the reservation controversy also expressed their disgruntlement claiming that the notional reservation package might face practical difficulties while implementation. The state cabinet met on Thursday and unanimously gave clearance to the notional reservation formula. Gurjar leader Kirori Singh Bhainsla had earlier announced that he was calling off the strike after a ‘positive’ response from the government to the quota woes of the community.

Voices of rebellion rise against Bhainsla
There is a sense of deja vu in the latest revolt against Kirori Singh Bhainsla by a section of Gurjar leaders who mostly belong to the BJP. The allegation by former ministers Nathu Singh Gurjar and Kalulal Gurjar, former Jaipur zila pramukh Ramgopal Guard, sitting MLA Hem Singh Bhadana and Bhainsla’s most-vocal critic Prahlad Gunjal against Bhainsla of cutting a deal with the governments at the cost of the community’s interests is debatable but their basic grudge is quite apparent. First, he hijacked the issue for which Guard had sat on a fast unto death for 10 days demanding ST status for the community before reaching an agreement. But Bhainsla refused to accept the agreement and began a violent agitation, which ended without any substantial gains. Still, the community accepted his leadership and accorded him the status of their sole voice, which understandably did not go down well with many leaders. What further aggravated their bruised egos is the fact that Bhainsla allegedly took unilateral decisions. This was precisely the reason that at the time of negotiations during the second Gurjar agitation in 2008, he was forced to seek approval from senior community leaders before signing the agreement with then chief minister Vasundhara Raje. This time once again Bhainsla held a one-to-one meeting with chief minister Ashok Gehlot. Not surprisingly, Bhainsla is accused by these leaders of making personal deals with the government. Apart from the appointments of his relatives as chairman of the Devnarayan Development Board and member of Rajasthan Public Service Commission during the BJP government, this time rumours of a Rajya Sabha ticket to his daughter has fuelled their suspicion against Bhainsla. While, all this may not be true but what hasn’t helped Bhainsla is the way all three times he raised expectations with his rhetoric but ended his agitations with a whimper. He has also not been successful in getting those deals implemented.

Gurjars set fresh deadline for govt
Community leaders join hands against KS Bhainsla, threaten to launch statewide agitation if demand not met by June 1
Gurjar leaders opposed to Kirori Singh Bhainsla have given an ultimatum to the state government for granting 5% separate quota to the community by June 1. Rejecting the agreement that promises 1% quota in addition to Gurjars’ existing share in the 21% reservation meant for the other backward classes (OBC) communities, the leaders threatened to launch a statewide agitation starting with “Rajasthan bandh” on June 13 if their demand was not fulfilled. The leaders, most of whom belong to the Bhartiya Janata Party (BJP), held a mahapanchayat (community mass-assembly) at Sikandara near Dausa on the Jaipur-Agra national highway on Thursday. The assembly was called by the All India Gurjar Aarakshan Sangharsh Samiti (AIGASS) that has been set up in opposition to Bhainsla’s Gurjar Aarakshan Sangharsh Samiti. Turning down the agreement reached between Bhainsla and chief minister Ashok Gehlot about the 1% additional quota, the new faction’s leader, former legislator Ramvir Singh Bidhuri addressed the mahapanchayat saying, “The accord is mere eyewash. Bhainsla has sold out the community’s interests to state government for personal gains.” Bidhuri slammed Bhainsla by alleging that the latter withdrew the recent Gurjar agitation when Congress promised a Rajya Sabha seat for his daughter. Emphasising for a separate 5% quota for Gurjars, Rebaris, Garia-Lohars and Banjaras within the constitutional limit of total 50% reservation, Bidhuri demanded that the state government should fill its current 80,000 vacancies under the new arrangement only. The AIGASS wants the government to separate 4% quota from the OBC’s 21% reservation and give it to Gurjars plus the three other communities. It also wants the 1% quota that had been lying unused before the reservation Act of 2008 came into existence. Other demands of the AIGASS include releasing Gurjar men arrested during the previous agitations and withdrawing cases against them.

Congress dubs it handiwork of Bharatiya janata party, saffron party rubbishes charges
Rajasthan’s caste cauldron is set to be stirred again with a section of Gurjar leaders announcing a mahapadaav at Matrikundia Dham in Chittorgarh on May 27. Though the Congress government may have succeeded in pacifying Kirori Singh Bhainsla and his supporters by assuring them of 1% reservation to the community in addition to its share in the OBC, another faction of community is getting ready to up the ante. Meanwhile the Congress has charged the BJP with supporting the mahapadaav given the fact that a number of leaders of the dissident group had been with the saffron party not too long ago. “Most of the dissident leaders have been associated with the BJP. And it’s now clear now that BJP wants to keep the issue alive,’’ said Congress spokesperson Satyendra Raghav. Bhainsla, too, without naming any party described it a collective attempt by “those having political affiliations” to mislead the community. However, BJP state president Arun Chaturvedi refuted the allegations saying, “These claims have no basis. I am not even aware of any such mahapadaav having been announced.’’ said Chaturvedi. On Wednesday, community leader Kalu Lal Gurjar, who was a minister in the previous BJP government, announced the date of the dharna in Bhilwara. He said that several other leaders of the community including Ramvir Singh Bidhuri, Hem Singh Badhana, Prahlad Gunjal, Nathu Singh Gurjar, Ram Gopal Guard and Gopi Chand Gurjar would take part in it. In the mahapadaav the leaders would draw the outline for the agitation which they plan to begin after June 13, he said. Alleging that Bhainsla made an agreement to further his personal interests, Kalu Lal mentioned that the community would continue to strive for its demand of 5% reservation under a separate category. “Barring Bhainsla and his supporters, the entire Gurjar community is against the agreement. Even 1% reservation which has been promised by the government would not be feasible under the given conditions,’’ he told DNA over telephone. Bhainsla however rubbished the claims saying, “I don’t even feel like responding to such baseless allegations.”
